Defects discovered after the final reception

A defect appearing after the final reception does not mean you have no remedy. The nature of the defect determines the applicable warranty and the deadline to act.

1. Shell: ten-year liability

Structural cracks, infiltrations, watertightness defects: the ten-year liability covers 10 years from the reception (provisional or final depending on case law).

2. Equipment: two-year warranty

Heating, electricity, ventilation, plumbing: the two-year warranty applies for 2 years. Beyond that, the hidden defect must be proved.

3. Hidden defects

Article 1641 of the Civil Code: the defect existed before the sale, was not apparent, and makes the property unfit. Action within short time after discovery.
