Final reception in Belgian public procurement contracts
The final reception in public procurement follows a specific regime defined by the Royal Decree of 14 January 2013 (GRE), distinct from the Breyne Law.
1. Legal framework
Articles 92 and following of the GRE. The contracting authority sets the warranty period in the specifications (minimum 1 year).
2. Procedure
Written request from the contractor, joint inspection, minutes of final reception or reasoned refusal within 30 days.
3. Security deposit
The security deposit (5% of the contract amount) is fully released upon final reception pronounced without reservations.
