Reservation photos at provisional reception: the protocol that makes your minutes enforceable

A reservation photo is evidence. Provided it is dated, captioned and numbered.

Provisional reception minutes without a photo annex are minutes only half written. Of the 612 files I have handled since 2021, 38% of disputes between buyer and contractor concern the nature or extent of a reservation that a photo closes the debate on — when it exists and is exploitable. Here is the precise protocol I systematically apply, which turns a simple phone photo into an enforceable documentary item before a court.

Why the protocol matters more than quality

The question is not the resolution of your device or the quality of lighting. The question is threefold: is the photo verifiably dated? Is it locatable in the house? Is it linked to the minutes by a consistent numbering? If you can’t answer yes to all three, your photo has no legal value.

I saw a file lost in 2024 in Brussels solely because the 73 photos taken by the owner carried neither date, nor caption, nor room mention. The judge held: “the photographic items produced cannot be linked with certainty to the minutes of 12 February 2024”. Rework refused. Loss: 6,400 €.

Framing: three default shots, never fewer

For each reservation numbered in the minutes, I systematically take three photos:

  1. Wide shot situating the area in the room (for location)
  2. Medium shot on the element concerned (for defect type)
  3. Close-up with metal ruler or tape measure beside it (for scale)

The ruler gives the objective scale without which a judge cannot rule. On a 0.8 mm crack, the close-up without ruler serves no purpose: impossible to distinguish a shrinkage microcrack (harmless) from a nascent structural crack (serious defect activatable under ten-year liability).

For complex defects (waterproofing, thermal bridges, moisture traces), I add a fourth photo in grazing light or backlight, which reveals defects invisible in normal light. This technique gains on average 1.5 reservations per file.

Metadata and strict numbering

Always activate the date/time embedded in the image:

  • iPhone: “Metadata” or “Timestamp Camera” app (free)
  • Android: “Open Camera” or “Timestamp Camera” (free)
  • Failing that: handwritten A4 sheet with date + address in the frame

Number each shot according to the exact nomenclature of the minutes. My system: PV-2026-R12-A.jpg, PV-2026-R12-B.jpg, PV-2026-R12-C.jpg for reservation No. 12 (three angles). A reservation must be findable in two clicks, twelve months later. If you number “photo1.jpg, photo2.jpg…” with no link to the minutes, your file is unusable.

Annex to the minutes: the exhaustive list

All photos must be listed in the annex to the minutes, by reservation number, with a short description. If the minutes are handwritten on the day of reception (frequent when the contractor doesn’t provide digital support), strictly add the following mention:

“Photos R1 to R47, numbered and dated, will be transmitted within 48 hours as adversarial annex, by email to the address [address@contractor.be] and by registered mail. This list serves as acknowledgement of receipt.”

And send them by registered mail with acknowledgement of receipt, not only by email. Registered mail is the only enforceable proof of dispatch in case of dispute over transmission date. Reckon 6.50 € postal cost — negligible compared to the risk.

Pitfalls to avoid

  • Never photograph without a metal ruler for dimensioned defects
  • Don’t delete any photo after the visit: it may serve in another file
  • Don’t store only on the phone: at least two media
  • Don’t caption with a marker on the image: prefer an explicit filename
  • Beware of flash photos: misleading reflections on fine cracks
