Before signing · 5 minutes
Download the pack, print the 8-point checklist and the annotated example. Get your draft notarial deed and the deposit certificate from your developer. Methodically check the 8 points with your pen: issuing bank, certificate number, calculation basis (excl. or incl. VAT), exact amount (5% of the excl.-VAT price in 99% of cases), issue date, validity period, release conditions, signatures. This step takes 5 minutes but can avoid thousands of euros in disputes.
If an anomaly is detected
Sign NOTHING. Open the letter template to the developer (Word), fill in your identity, the property address, and tick the non-compliant items. Print two copies, sign, send by registered mail with acknowledgement of receipt. Most developers correct within 5 to 10 working days (they know that the contract is null and void by operation of law without a valid certificate, Article 12 Breyne Law).
On the day of the notarial deed
Bring the completed checklist to the notary. Compare with the original certificate. Refuse to sign if an anomaly remains — it is your last chance to act before 12 months of warranty. If everything is compliant: sign knowing that you have fulfilled your duty of care. Keep the signed checklist and a copy of the certificate in your file.
